Connecticut Social Security Disability
If you are suffering from a disability and you cannot do the work you did before, cannot adjust to other work because of your medical conditions, and your disability has lasted or is expected to last at least a year or result in death, you may be eligible for Social Security Disability benefits.
Attorney Neal E. Guttenberg has handled Social Security Disability claims alongside his immigration practice, and the firm is a member of the National Organization of Social Security Claimants’ Representatives (NOSSCR). If you are disabled or injured, the firm will try to travel to you.
Conditions that may qualify
Many conditions can qualify, including blindness or deafness, breathing problems, cancer, chronic heart disease, extreme psoriasis involving the hands and feet, HIV, immune system disorders, mental disorders, multiple sclerosis, neurological disorders, obesity, rheumatoid arthritis, seizures despite medication, and other severe medical conditions.
How Social Security decides
The Social Security field office first checks that you are financially eligible and are not doing a substantial amount of work. It then sends the claim to Disability Determination Services, a state agency, which asks in order:
- Is your impairment severe?
- Does it meet or equal a listing in Social Security’s impairment listings, often called the Blue Book?
- Can you do your past work?
- Can you do any other work, given your limitations, age, education and skills?
SSDI or SSI?
| Social Security Disability Insurance | Supplemental Security Income | |
|---|---|---|
| Who qualifies | Workers who paid Social Security taxes and are insured | Adults and children with limited income and resources |
| Payment | Based on the worker’s earnings record | Based on need, up to the federal benefit rate |

Appeals
If you disagree with a decision, there are four levels: reconsideration by someone who did not make the first decision; a hearing before an administrative law judge, where you and your representative present your case; Appeals Council review; and a civil suit in federal district court.

FAQ
Social Security Disability questions
Still have questions? Call us any day and ask.
What is the difference between SSDI and SSI?
Social Security Disability Insurance is for workers who paid Social Security taxes and are insured, and the benefit is based on the worker's earnings record. Supplemental Security Income is needs-based: the person must have limited income and resources and meet citizenship or certain immigration-status rules.
My claim was denied. What now?
There are four levels of appeal: reconsideration, a hearing before an administrative law judge, Appeals Council review, and a civil suit in federal district court. Each step has a deadline, so call as soon as you receive the denial.
Do I need a lawyer for a disability claim?
There is no requirement to have an attorney. A lawyer can gather your medical records, ask your doctors, therapists and case workers for opinion evidence in a useful format, and prepare you for the questions at a hearing.
